1. Acceptance and eligibility

By accessing or using the EmeraldPost website (the “Site”) and any associated educational content or workshop information (together, the “Services”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Services.

You must be at least 16 years old to use the Services. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Services and that your parent or guardian has read and agrees to these Terms on your behalf.

2. Service description

EmeraldPost provides beginner-friendly educational information related to professional kitchen environments. Content may include guides on kitchen organisation, station setup, equipment awareness, hygiene routines, workflow concepts, and general training materials intended to support understanding of foodservice workspaces.

The Services are informational and educational only. We do not provide professional legal, regulatory, engineering, or safety consultancy. Any actions you take based on our content are your responsibility. Always follow your workplace policies and procedures, applicable regulations, and manufacturer instructions for equipment.

Workshop pages may describe learning sessions, formats, or topics. Unless explicitly stated on the Site, workshops are not presented as accredited programmes and do not guarantee any qualification, employment outcome, or certification.

3. Accounts and user obligations

Some parts of the Services may be available without an account. If we introduce accounts or registration features, you agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of any login credentials and for all activity under your account.

You agree to use the Services only for lawful purposes and in a manner consistent with these Terms. You must not interfere with the operation of the Site, attempt to access restricted areas, or use automated means to access or copy content except as permitted by applicable law.

Where accounts are offered, we may limit use to one account per person, and we may require additional verification to protect the Site and its users.

4. Intellectual property

The Services, including text, layout, design, graphics, logos, icons, and any associated software code, are owned by EmeraldPost or its licensors and are protected by intellectual property laws.

Subject to your compliance with these Terms, EmeraldPost grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Services for your personal, non-commercial educational purposes. This licence does not grant you the right to reproduce, distribute, publicly display, modify, create derivative works, or otherwise exploit the Services except where such use is expressly permitted by EmeraldPost in writing or required by law.

Trademarks, names, and logos displayed on the Site are the property of EmeraldPost or their respective owners. Nothing in these Terms grants any right to use any trademark without prior written permission.

5. Prohibited activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for any unlawful purpose or in violation of any applicable regulations.
• Attempting to gain unauthorised access to the Site, accounts, systems, or networks.
• Scraping, crawling, or using automated tools to extract content, data, or source code without permission.
• Reverse engineering, decompiling, or attempting to discover source code or underlying algorithms, except to the extent permitted by law.
• Uploading, transmitting, or distributing malware, viruses, or any harmful code.
• Impersonating another person or misrepresenting your affiliation with any organisation.

We may investigate suspected violations and may suspend or terminate access as described in Section 13.

To the fullest extent permitted by law, EmeraldPost disclaims all warranties and representations of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free from harmful components. We do not guarantee the accuracy, completeness, or usefulness of any content, and we may update, remove, or change content at any time.

Any reliance on the content is at your own risk. Always follow professional training, workplace procedures, and manufacturer guidance when operating equipment or performing hygiene tasks.

7. Limitation of liability

To the maximum extent permitted by law, EmeraldPost will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Services.

To the maximum extent permitted by law, EmeraldPost’s total direct liability for any claims arising out of or related to the Services will not exceed the amount paid by you to EmeraldPost for the Services in the twelve (12) months immediately preceding the event giving rise to the claim, or 100 EUR, whichever is lower.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, where such limitations are not permitted.

8. Indemnification

You agree to indemnify, defend, and hold harmless EmeraldPost, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.

9. Third-party links

The Services may reference third-party resources for background reading. If the Site contains links to external websites, those links are provided for convenience only. EmeraldPost does not control and is not responsible for the content, policies, or practices of any third-party websites or services.

Your use of third-party websites is at your own risk and may be subject to those third parties’ terms and policies.

Your privacy is important to us. Our collection and use of personal data, cookies, and similar technologies are described in our Privacy Policy, which is incorporated into these Terms by reference.

If you contact us through a form or by email, you agree that we may use the information you provide to respond to your enquiry and maintain appropriate records as described in the Privacy Policy.

11. Governing law

These Terms and any dispute arising out of or relating to the Services are governed by the laws of Ireland. The courts of Dublin, Ireland will have exclusive jurisdiction, subject to any mandatory consumer protection provisions that apply in your place of residence.

12. Dispute resolution

Before filing a claim, you agree to contact us and provide a brief written description of the issue and your requested resolution. The parties agree to attempt to resolve the dispute informally for at least 30 days from the date we receive your notice.

If we cannot resolve the dispute within that period, either party may bring a claim in the courts specified in Section 11.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a security risk, or misuse the Services.

Upon termination, the licence granted to you in Section 4 will end. Sections that by their nature should survive termination will survive, including Sections 4 (Intellectual property), 6 (Disclaimer of warranties), 7 (Limitation of liability), 8 (Indemnification), 11 (Governing law), and 12 (Dispute resolution).

14. Modifications

We may modify these Terms from time to time. Updated Terms will be posted on this page and will become effective 14 days after posting. By continuing to use the Services after the effective date, you agree to the updated Terms.

If the changes are material, we may also provide notice through the Site. You are responsible for reviewing the Terms periodically.
